The amending regulation of 24 May 2025 shifted return shipping costs to the seller, brought products such as phones and computers back within the right of withdrawal, and added return carrier and mandatory mediation details to the preliminary information. Most templates online still use the old text.
Council of State Ruling Applied
By decision E.:2022/5534 of 30 June 2025, the Council of State 10th Chamber suspended the withdrawal exceptions for registrable vehicles and goods that have been installed or assembled. This tool does not list those provisions.

Frequently Asked Questions
Are the Preliminary Information Form and the Distance Sales Contract the same thing?
No, they are separate documents and both are mandatory. The Preliminary Information Form is the disclosure provided before payment; the Distance Sales Contract is the binding agreement concluded at the point of payment. This tool produces both.
Who pays the return shipping cost?
The seller, as of 1 January 2026. If you named a return carrier in the preliminary information, the consumer cannot be held liable for return costs. If you named none, no charge whatsoever may be requested from the consumer. If the carrier you named has no branch where the consumer is located, you must arrange collection at no additional cost.
Can mobile phones and computers be returned?
Yes. Regulation Art. 15/1-(i), which excluded these products from the right of withdrawal, was repealed by the amendment of 24 May 2025 and took effect on 1 January 2026. Consumers may now return phones, smartwatches, tablets and computers within 14 days of delivery.
